Man Facing Federal Charges for Child Pornography

The United States Attorney’s Office for the Middle District of Pennsylvania announced Wednesday that Brian Tate, age 34, of Gordon, Pennsylvania, was indicted on November 15, 2016, for attempting to entice a minor to engage in illegal sexual activity and transporting child pornography.

According to United States Attorney Bruce D. Brandler, the indictment alleges that between October 17, 2016 and November 9, 2016, Tate used the internet to attempt to persuade and entice a minor to engage in illegal sexual activity, and during that same time period transported child pornography by any means, including by computer.

If convicted, Tate faces a mandatory minimum sentence of 10 years in prison and a potential maximum sentence of life in prison for the attempted enticement of a minor charge, and a mandatory minimum sentence of five years in prison and a potential maximum sentence of 20 years in prison for transporting child pornography.

The case was investigated by Homeland Security Investigations, United States Postal Inspectors, and the Pennsylvania State Police. Assistant United States Attorney Francis P. Sempa is prosecuting the case.

This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by the United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims. For more information about Project Safe Childhood, please visit www.usdoj.gov/psc For more information about internet safety education, please visit www.usdoj.gov/psc and click on the tab "resources."

Indictments and Criminal Informations are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court.

A sentence following a finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.

The maximum penalty under federal law for these offenses is life imprisonment, a term of supervised release following imprisonment, and a fine. Under the Federal Sentencing Guidelines, the Judge is also required to consider and weigh a number of factors, including the nature, circumstances and seriousness of the offense; the history and characteristics of the defendant; and the need to punish the defendant, protect the public and provide for the defendant's educational, vocational and medical needs. For these reasons, the statutory maximum penalty for the offense is not an accurate indicator of the potential sentence for a specific defendant.

Senator David G. Argall (R-Schuylkill/Berks) will continue to serve as Chairman of the Senate Majority Policy Committee for the 2017-18 legislative session. Senator Argall was re-appointed to the position by Senate President Pro Tempore Joe Scarnati as part of the Senate Republican Caucus’s reorganization that took place on Wednesday morning at the state Capitol.

Argall was first appointed to the post in 2014 for the 2015-16 legislative session. He is the first senator from the 29th Senatorial District to hold a leadership post since the 1860s.

“I’m honored to continue serving in this role and to work with my colleagues to develop legislation on critical issues affecting our region and our state,” Argall said. “We’ve been very active over the last two years with the committee through bringing together stakeholders on key issues ranging from economic development to welfare reform, from pet protection to budget reforms. It’s an all-encompassing committee.”

Argall explained that the committee works with Senators to develop legislation important to their constituencies. Throughout the next legislative session the committee will also focus on taking a closer look at ways to reduce state spending, in what is anticipated to be another difficult year for the state budget.

“Taxpayers continue to tell us over and over that government should live within its means,” Argall stated. “I am confident that the Policy committee will play a key role in identifying real cost savings for taxpayers.”

Chairman Argall plans to continue reviewing big-picture issues, like the state’s shifting demographic trends, which affect suburban, rural and urban areas of the state differently.

Senate’s Failure to Vote on HB2375 Forces Labor and Industry Layoffs

$

The Pennsylvania Department of Labor & Industry today announced that it will lay off nearly 600 of its staff as a result of the Senate’s failure to vote on HB2375, which would have allowed for $57.5 million in funding to administer unemployment benefits to out-of-work Pennsylvanians. The bill, a bi-partisan piece of legislation, was passed by the House on October 19.

“The Senate put politics before people and now 600 employees will be without a job just before the holidays,” Labor & Industry Secretary Kathy Manderino said. “It’s beyond disappointing; it’s disgraceful.”
“This was not a last-minute ask, but rather what should have been a logical conclusion to conversations that began in April about extending a statute that was already in place and that has allowed the department to administer unemployment benefits in a timely manner.”
HB2375 was crafted in response to the sunset of Act 34, which provided a four-year transfer from the state’s Unemployment Compensation (UC) Fund to the Unemployment Compensation Service and Infrastructure Improvement Fund to improve the quality, efficiency and timeliness of UC services and to work to replace the department’s 40-year-old Legacy computer system.

The department used Act 34 funds to reduce call wait times by more than an hour in the past two years and in 2016 the system met goals set by the federal Department of Labor that it had failed previously.

Early in 2016, the department asked for $57.5 million in funding to keep up planned system improvements amidst decreased federal funding for UC administration.

“Without the $57.5 million in funding, there is simply not enough money to pay staff,” Manderino said. “The department has made great strides in efficiency and now, due to the Senate’s lack of action, those strides – and service to our state’s unemployed – have been jeopardized.”

Over 180 veterans from the Vietnam era were honored during a ceremony hosted by Senator David G. Argall (R-Schuylkill/Berks) and Representative Barry Jozwiak (R-Berks) at Hamburg Area High School Thursday night.
The veterans are residents of the 29th Senatorial District, which Argall represents, comprised of all of Schuylkill County and the western and northern portion of Berks County.

“Tonight’s event is a reminder of how blessed we are as a nation,” Argall said. “These veterans sacrificed a lot to serve their country during the Vietnam conflict. This commemoration event is our way of saying thanks and recognizing them for their selflessness and service.”

“We want our Vietnam War veterans to know that we remember their sacrifices,” Jozwiak said. “These veterans answered their country’s call to service and that is something we will always remember.”

During the event, Argall and Jozwiak presented each veteran and widows of Vietnam era veterans in attendance with a special Vietnam veteran’s lapel pin. Pastor Mark Johnson of the Bausman Memorial United Church of Christ in Wyomissing provided the invocation while the Hamburg Area School District’s Aerial Boundaries choir sang the Star Spangled Banner.

Seventy-two Vietnam era veterans from Schuylkill County and 117 Vietnam era veterans from Berks County participated in the program.

The commemorative event was held in conjunction with the Department of Defense as part of a nationwide tribute to Vietnam era veterans to commemorate the 50th anniversary of the war.
