Juveniles Facing Drug Charges

ORWIGSBURG - On Friday, June 16, 2017 at approximately 11:30 p.m., the Orwigsburg Police stopped two male juveniles near the intersection of S. Liberty Street and Ridge Road for an apparent violation of the Borough curfew ordinance. 

During the course of contact, both were found to have been in possession of drug equipment.  Both juveniles will have to answer to charges for possession of drug paraphernalia as well as curfew restrictions in front of Schuylkill County juvenile court.

Man Facing DUI and Drug Charges

ORWIGSBURG - On Friday, June 16, 2017 at approximately 10:30 p.m., the Orwigsburg Police stopped a vehicle for pulling out from a stop sign located at S. Liberty Street and W. Market Street at a time when it was not safe to do so. 

Investigation at the scene revealed that not only was the operator under the influence of a drug or combination of drugs to the degree which he was incapable of safely operating a vehicle, he was also in possession of a small amount of marijuana and drug paraphernalia. 

The driver , Gavin Ahearne, 18, of Schuylkill Haven, was arrested and transported to the Lehigh Valley Health Network-Schuylkill South campus where he consented to a chemical test of blood.  Pending the receipt of chemical test results, charges for DUI, possession of a small amount of marijuana, and possession of drug paraphernalia will be filed.

Man Facing DUI and Harrassment Charges After Road Rage Incident

On Saturday, June 17, 2017 at approximately 5:55 p.m., Orwigsburg police officers witnessed an altercation between a two parties occurring outside the entrance to the Orwigsburg Borough Hall parking lot. 

Investigation at the scene revealed that the altercation was the result of a road rage incident that began coming into the Borough on E. Market Street from Brick Hill Road.  Robert Wagner, 43, of Orwigsburg, who was operating a vehicle following the victim, was tailgating the victim and attempted to pass the victim on a double yellow line in the 200 block of E. Market Street. 

The victim attempted to drive to the Orwigsburg Police Department to report the incident; however, was followed there by Wagner who engaged in a verbal altercation with the victim outside Borough Hall. 

Wagner was found to be under the influence of alcoholic beverages to the degree which he was incapable of safely operating a vehicle upon a highway. 

Wagner was arrested and transported to the Lehigh Valley Health Network-Schuylkill South campus where he consented to a chemical test of blood.  Pending the receipt of the chemical test results, charges for DUI, harassment, disorderly conduct, public drunkenness, and all applicable summary violations will be filed.

PA Senate Passes Libre's Law to Stiffen Animal Cruelty Penalties

On Tuesday, The Pennsylvania Senate voted and passed Libre's Law that would make it a felony to abuse animals in Pennsylvania.


Libre’s Law would stiffen the penalties for people found to neglect or abuse animals.

If violators are found guilty of aggravated cruelty, they could face seven years in jail.

The bill came close to passing the legislature last year but ran out of time and the session ended.

Libre's Law wasintroduced in 2016, and is named after the dog Libre, who was rescued from a Southern Lancaster County farm, suffering from a severe case of neglect.

Libre's Law, House Bill 1238, sets up stiffer penalties for people found guilty of animal neglect and cruelty. The penalties can range anywhere from 90 days in jail and a $300 fine to aggravated cruelty which could land someone in prison for up to seven years and also a $15,000 fine.

The bill will now move to the House of Representatives for a vote.

First Medical Marijuana Growing Permits Announced

The Pennsylvania Department of Health today released information on the issuance of 12 permits for medical marijuana growers/processors in the state.

The permittees will now have six months in which to become operational before they can begin growing medical marijuana. Entities receiving permits were notified by mail.

“With today’s announcement, we remain on track to fulfill the Wolf Administration’s commitment to deliver medical marijuana to patients in 2018,” said John Collins, Director of the Office of Medical Marijuana. “The applications from the entities receiving permits were objectively reviewed by an evaluation team made up of members from across commonwealth agencies. Any letters of recommendation or support for an applicant were not considered during the evaluation.”

The 12 permits were issued to:

Southeast Region
 - Prime Wellness of Pennsylvania, LLC
 - Franklin Labs, LLC

Northeast Region
 - Pennsylvania Medical Solutions, LLC
 - Standard Farms, LLC

Southcentral Region
 - Ilera Healthcare, LLC
 - AES Compassionate Care, LLC

Northcentral Region
 - Terrapin Investment Fund 1, LLC
 - GTI Pennsylvania, LLC

Southwest Region
 - AGRiMED Industries of PA, LLC
 - PurePenn, LLC

Northwest Region
 - Holistic Farms, LLC
 - Cresco Yeltrah, LLC

Scores for all grower/processor applicants will be available today on the Department of Health website at www.health.pa.gov.

“The next step for the permit holders will be to ramp up their operations so they can prepare to grow medical marijuana,” Collins said. “Our teams will perform a series of site inspections before the locations can be certified as operational. Once that happens, the permittees will be able to begin growing and processing medical marijuana.”

The Office of Medical Marijuana received 457 total applications: 177 for growers/processors; and 280 for dispensaries.

The Medical Marijuana Program was signed into law by Governor Tom Wolf on April 17, 2016. Since that time, the department has:

Completed the Safe Harbor temporary guidelines and Safe Harbor Letter application process, as well as approved 271 applications;

Completed temporary regulations for growers/processors, dispensaries, laboratories and physicians which have been published in the Pennsylvania Bulletin;

Released Phase One permit applications for grower/processors and dispensaries;

Developed the Medical Marijuana Physician Workgroup;

Drafted temporary regulations for practitioners to participate in the program; and

Selected the woman-owned company MJ Freeway to implement a seed-to-sale electronic tracking system.

The Medical Marijuana Program became effective on May 17, 2016, and is expected to be fully implemented in 2018. The program will offer medical marijuana to patients who are residents of Pennsylvania and under a physician’s care for the treatment of a serious medical condition as defined by Act 16.

PennDOT to Phase in Newly-Designed Driver Licenses, Identification Cards

As part of ongoing security enhancements, the Pennsylvania Department of  Transportation (PennDOT) has updated the design and enhanced the security features of its driver license and identification card products.


PennDOT entered a new contract with MorphoTrust USA in August of 2015 for the design and issuance of Driver License (DL) and Identification (ID) cards.

Over the last 22 months, PennDOT has worked with MorphoTrust USA on planning, design
and deployment of this major new security enhancement initiative. This update is unrelated to the REAL ID Act.

“The update is an important component of PennDOT’s ongoing work to enhance and
protect the integrity of the driver license and identification card issuance
process,” said PennDOT Secretary Leslie S. Richards.

PennDOT began a pilot of the new products beginning on Monday, June 19 at the
Riverfront Office Center location in Harrisburg. All Driver and Photo centers
will transition to the new products by the end of October 2017. The new products will be phased in over the next four-year renewal cycle and will replace existing products. Both current and new card designs will be in circulation during the transition period.

The new cards are not REAL ID-compliant. System, building infrastructure and process changes will be necessary for Pennsylvania to issue REAL ID-compliant products. PennDOT anticipates that REAL ID-compliant driver licenses and identification cards will be available at customer’s option in 2019.

The cards look very different, but they also have additional enhanced security features, which improve fraud prevention and protect from counterfeiting and alteration.

Some of the enhanced features include:
• Larger primary portrait and smaller ghost portrait
• 2D barcode, which contain data from the front of the card unique to the cardholder
• Laser perforation - The keystone outline with “PA” is embedded into the card stock and can be observed by holding the card up to any light source
• Laminate - Each card is laminated with an optically-variable pattern with the state motto, “Virtue, Liberty, Independence,” Keystone outline and “1787,” the year when the U.S. Constitution was ratified by Pennsylvania.

In addition to the above changes, the magnetic strip has been eliminated on the back of the newly designed driver’s license and identification cards.

Barnesville Death Ruled Homicide; Police Looking for Son as Suspect

Police have ruled a death in Barnesville and identified the victim's son as the suspect.

On Monday morning, just after 11:30am,  PSP Frackville responded to 21 Pear Street, Barnesville, Ryan Township for a death investigation.

The victim was later identified as Gary Marchalk, 60.

A thorough investigation was conducted by the Troop L Major Case Team which lead to an arrest warrant for the actor, Michael Marchalk, 37.

Michael is charged with criminal homicide, murder of the first degree, murder of the second degree, murder of the third degree, voluntary manslaughter, aggravated assault, robbery, theft, theft of a motor vehicle, access device fraud, and recklessly endangering another person.

Michael was last seen operating his parents 2015 Gold Ford Fusion bearing Pennsylvania Registration JWD1566.

Police Investigating Card Skimming at Gas Station near Frackville

West Mahanoy Township Police are currently investigating a report of a skimming device being found at a gas station near Frackville.

Police are reporting that the skimming device was installed in a pump at the Exxon Gas Station located at 541 Altamont Boulevard near Frackville between June 18th and June 19th.

Anyone who paid a the pump between the above dates should check their credit/debit card statements for any fraudulent purchases.

Charlotte M. Muldowney, age 76, of Pottsville, PA passed away with her family by her side on Sunday, June 18th, 2017 at Schuylkill Center in Pottsville.

Born in Frackville, PA on November 13, 1940, she was the daughter of the late Hipolit and Kazmira Marie (Gorskie) Iwaszkiewicz and the late Frank Powanda and Sarah E. (Iwaszkiewicz) Powanda of Pottsville, who raised Charlotte.

Charlotte was a graduate of Frackville High School, Class of 1958 and then earned a Business Degree from the Ford Business School in Pottsville. She worked as a book keeper for the Schuylkill Haven Borough for over 25 years until retiring in 2001 and also worked as a switchboard operator for Boscov's Department Store in Pottsville.

Charlotte was a member of Freedom of Christ Church of Schuylkill County in Pottsville, she enjoyed her volunteer work for Covenant Home Care and Hospice and the Friends of Hospice. Charlotte dedicated herself to helping the senior citizens at the Queen of Peace Apartments in Pottsville. She supported various charities such as the charities, Wounded Warriors and the Disabled and Paralyzed Veterans. Charlotte loved cooking, playing Pinnocle, and mostly loved to just spend time with her family.

In addition to her parents and father Frank, she was preceded in death by her exhusband Hubert J. Muldowney, six sisters: Geneive Iwaszkiewicz, Estelle Etcho, Helene Bobiak, Geneive "Jenny" Polifka, Josephine Miller, and Jacqueline Reigel, and two brothers: Albert Ives and Rudolf Ivas.

Charlotte is survived by her Mom Sarah; a daughter Diana D. Hess and her husband David, Pottsville; 2 sons: Christopher B. Muldowney and his wife Tracey, Milton, FL and Eric J. Muldowney and his wife Jennifer, Pottsville; 5 grandchildren: Zachary, Delaney, Aaron, Yasmine, and Joel Jr.; a brother Walter Ivas, Summerville, NJ; 2 sisters: Dorothy Moser, Fort Myers, FL and Patricia Penberth, West Berlin Twp. NJ; and many nieces and nephews.

A Memorial Service will be held at the Freedom in Christ Church of Schuylkill County, 1850 First Ave., Pottsville at 11AM on Wednesday, June 21st, with Pastor James Shields officiating.

Relatives and Friends are invited to visit with the family on Wednesday morning from 10 to 11AM at the Freedom in Christ Church.

Interment will be held private.

In lieu of flowers, memorial contributions may be made to Covenant Home Care & Hospice 1223 Pottsville Pike Shoemakersville, PA 19555.

Jacqueline "Jacque" Patrick, 86 years of age of Golf Road West Penn Twp., Tamaqua, Pennsylvania passed away peacefully on Monday, June 19, 2017 in West Penn Township after a brief illness.

Widow of Edward "Pat" Patrick who passed away on October 3, 2010.

Born Wednesday, October 29, 1930. daughter of the late Catherine Foran, she is survived by her; daughter, Mrs. Suze Racho wife of Mike of Andreas; son, Richard E. Patrick and his wife Penny of Tamaqua; grand children, Kesley, Kyle, and Brian and his wife Kalene. .

A Mass of Christian Burial will be celebrated on Friday June 23, 2017 at 11 o'clock AM at SS. Peter & Paul RCC located at 307 Pine St Tamaqua, Pennsylvania 18252. The family will receive friends on Friday morning from 10:00 A.M. until time of services in church.

Interment will be in SS. Peter & Paul R.C.C. Cemetery, Tamaqua, Pennsylvania.

Verna W. Russell, 96, passed away Monday at Orwigsburg Center, where she had been a resident.

Born in Womelsdorf, March 7, 1921, she was a daughter of the late John A. and Annie E. Dietrichs Walmer.

Verna had been previously employed as a seamstress.

She is survived by a sister, Pearl Yeager, Fleetwood; a brother-in-law, Robert Ederis, Myerstown; a daughter, Linda J. Russell, Pottsville; two grandchildren, Nicole Fanok, companion of Andy Geary, Pottsville, and Al Saiauskie, Pine Grove.

A private graveside service will be held at the family's convenience at Schuylkill Memorial Park, Schuylkill Haven.

FYE in Schuylkill Mall to Close Doors Next Week

After extending the date, FYE in the Schuylkill Mall has announced an official closing date.

According to store manager Brian Gross, the final day of sales will officially be Tuesday, June 27th.

The store had previously announced a closing date back in May but later extended it into June.

No plans have been made with the company to move the store to another mall locally.

On February 28th, 2017, FYE began a liquidation sale of most of it's products. The store is expected to increase the percentage off on products as the closing date approaches.

FYE, owned by Transworld Entertainment, has been in the mall since the early 2000's when Trans World purchased Disc Jockey.

The Schuylkill Mall is scheduled to close later this year.

Attempts to communicate with Northpoint on their plans have not been successful.

Woman Facing Theft of Services Charge

According to the Pennsylvania State Police at Frackville, Jennifer Lynn Hoffman, 36, of Pottsville ran out of gas on the night of Tuesday, June 6, 2017. 

Police say a service provider had to be summoned to bring gasoline, where Hoffman implied to the service worker that she would pay via a credit card.

Once receiving the service, Hoffman refused to pay.  She was also given a generous grace period to pay the service fee, but she declined.

Hoffman is now facing a charge of theft of services.

Woman Facing DUI Charges

On Monday, June 19, 2017 around 9:30 p.m., the Orwigsburg Police Department stopped a vehicle for committing several vehicle code violations which began at the intersection of S. Wayne Street and S. Liberty Street. 

The driver, Diane Sophy, 53, of Minersville was found to be manifestly under the influence of alcoholic beverages to the degree which she was incapable of safely operating a vehicle upon a highway. 

Sophy was arrested and transported to the Lehigh Valley Health Network-Schuylkill South campus where she refused to submit to a chemical test of blood. 

Sophy will be charged with DUI and all applicable summary violations.

Man Facing Harassment Charges

On Wednesday, 06/21/17, around 7:50pm, Frackville State Police responded to the 1300 Block of Walnut Street in Ashland for a harassment incident.

Police say Adam Bobyak, 21, of Ashland, allegedly shoved his neighbor, Augustin Kukuk, 27, to the ground during an argument in front of his residence.

Bobyak was cited with Harassment.

Vehicle Crashes into Building in Orwigsubrg

A vehicle crashed into a building on Thursday in Orwigsburg.


On Thursday, June 22, 2017 the Orwigsburg Police Department was dispatched to Federal Square, located at 705 W. Market Street, for a report of a vehicle into a building.

Upon arrival and subsequent to investigation at the scene, it was found that the crash occurred as a result of operator error, causing the vehicle to strike a structural column in front of Pheonix Rehabilitation.

The vehicle was operated by George Heffner of Orwigsburg, who was not injured as a result of the crash.

Moderate damage was incurred by both the building and Heffner’s vehicle, which was towed from the scene.

The Orwigsburg Police Department was assisted by the Orwigsburg Fire Company and VJ Wood Towing of Hamburg.

Attorney General Joins Search for Man Charged for Schuylkill County Murder

Attorney General Josh Shapiro and the Pennsylvania State Police are seeking the public’s help in finding Michael Marchalk, who is charged with murder in the death of his father, Gary Marchalk.

Gary Marchalk, 60, was found bludgeoned to death in his Schuylkill County home on Monday, June 19. His wallet and car – a gold Ford Fusion with Pennsylvania license plate JWD1566 – had been stolen.

Schuylkill County District Attorney Christine Holman referred the case to the Office of Attorney General Shapiro. OAG prosecutors approved murder and theft charges against Michael Marchalk, 37, on June 20. Gary Marchalk, the decedent, was the husband of Schuylkill County Treasurer Linda Marchalk.

Investigators say Marchalk was last seen at a Philadelphia bus terminal, though authorities are unsure if he boarded a bus. A photograph of the defendant is attached.

Two from Schuylkill County Die in Lebanon County Crash on Interstate 81

Two people from Schuylkill County died in a crash on Interstate 81 in Lebanon County Thursday evening.

According to the Pennsylvania State Police,  the incident occurred around 8:30pm when a tractor trailer traveling southbound lost control near Milemarker 89 and crossed the center median into northbound traffic.

The tractor trailer struck a vehicle driven by Haley Wetzel, 19 with Julia Williams, 60, as a passenger.  Both were from Pottsville.

Wetzel and Williams both died from their injuries suffered in the crash.

Route 309 Closed South of Tamaqua in Lehigh County

(06/23/17) As of 9:00am, Friday, Route 309 is reported to be closed in both directions due to a crash.


Details are not available on the crash at this time but the location is reported to be on the south side of the Blue Mountain in Lehigh County.

UPDATE:  A coroner has reportedly been called to the crash.

Pharmacy Assistant Charged for Stealing Thousands of Prescription Pills from a Pharmacy

Attorney General Josh Shapiro announced Friday criminal charges against a Schuylkill County pharmacy assistant who stole nearly 30,000 prescription pills, including more than 27,000 Oxycodone pills. The pills had an estimated street value of $565,000.


Jamie Karmonick, 41, of South Main Street, Mahanoy City, is charged with a felony – acquisition or obtaining possession of a controlled substance by misrepresentation, fraud, forgery, deception or subterfuge – and related charges including theft.
“We will prosecute anyone who diverts prescription drugs from their intended purpose,” Attorney General Josh Shapiro said. “Our arrests for the illegal diversion of prescription drugs doubled from the first quarter last year to the first quarter this year. It’s a critical part of the opioid epidemic plaguing our Commonwealth, and we’re committed to prosecuting these illegal diversions wherever we uncover them.”
Attorney General Shapiro noted studies showing that 75 percent of heroin users began their drug abuse by abusing prescription opioids. Oxycodone is an opioid pain medication. In 2017, Office of Attorney General agents have charged 96 persons for illegally diverting prescription drugs – including 4 others in Harrisburg this week for using a doctor’s prescription pad to fraudulently obtain 3,000 Oxycodone pills.
The Schuylkill County investigation began in March when a pharmacist at Alliance Medication Services in Tamaqua noticed a discrepancy in the number of Oxycodone tablets documented on the pharmacy’s computer system. The pharmacist contacted the Schuylkill County District Attorney’s Office, which in turn contacted the Office of Attorney General’s Bureau of Narcotics Investigation and Drug Control.
An audit of the pharmacy’s computer system – with the assistance of the Drug Enforcement Administration - revealed a discrepancy and loss of nearly 30,000 prescription pills, as well as evidence the pill counts were fraudulently edited by Karmonick at her computer terminal on numerous occasions.
An Office of Attorney General narcotics agent interviewed Karmonick at her home shortly after the thefts were uncovered, and the defendant admitted stealing the medication, which she claimed was for personal use. In addition to the Oxycodone thefts, Karmonick stole multiple quantities of Morphine, Clonazepam, Lorazepam, Hydrocodone-Acetaminophen and Tramadol. The investigation is ongoing.
“I want to commend the law enforcement cooperation in this case, from the Schuylkill County District Attorney’s Office as well as the Drug Enforcement Administration,” Attorney General Shapiro said. “I also want to thank the pharmacy for alerting law enforcement to this serious crime.”
Karmonick was arrested today for the illegal drug diversions and thefts, and bail was set at $25,000 unsecured. A preliminary hearing was set for July 11th. Karmonick will be prosecuted by the Schuylkill County District Attorney's office.

Man Wanted for Murder of Father Captured in Atlantic City

A man wanted for murdering his father earlier this week has been captured in Atlantic City.

According to the Pennsylvania State Police at Frackville, Michael David Marchalk was apprehended on the Atlantic City Boardwalk at 11:50am on Friday.

He will be incarcerated pending extradition as a Fugitive from Justice.

On Monday morning, just after 11:30am,  PSP Frackville responded to 21 Pear Street, Barnesville, Ryan Township for a death investigation.

The victim was later identified as Gary Marchalk, 60.

A thorough investigation was conducted by the Troop L Major Case Team which lead to an arrest warrant for the actor, Michael Marchalk, 37.

Michael is charged with criminal homicide, murder of the first degree, murder of the second degree, murder of the third degree, voluntary manslaughter, aggravated assault, robbery, theft, theft of a motor vehicle, access device fraud, and recklessly endangering another person.
