Joint, Bipartisan Senate Policy Committee to Study Possible School District Consolidation

The Senate Majority Policy Committee and the Senate Democratic Policy Committee will discuss possible school district consolidation during a public workshop discussion. This workshop will take place on Monday, June 17, at 10:00 a.m. in Room 471 of the Main Capitol Building in Harrisburg.
“With 500 school districts in Pennsylvania this issue must be reviewed carefully,” said Senate Majority Policy chair David G. Argall (R-Schuylkill/Berks). “Senator Boscola and I are hosting this bipartisan workshop to consider the benefits and disadvantages of school district consolidation. In Maryland, each of that state’s 23 counties and the city of Baltimore only has one school district. Do we really need 500?”

“Our goal for the workshop is to listen to stakeholders from across Pennsylvania about the potential impacts both good and bad resulting from school district consolidation,” said Senate Democratic Policy chair Lisa Boscola (D-Lehigh/Northampton). “Any proposal that would potentially keep taxpayer dollars in the pockets of citizens and improve our public education system is worth studying,” Boscola added.

Shenandoah Valley found out recently that they have recycled tons of trash since starting their project.

According to the Shenandoah Valley School District, recycling isn’t just a topic of discussion, it is a practice that the students, faculty and employees utilize on a daily basis.

In each classroom, office and work areas special bins are placed where paper, cardboard, plastic and other recyclables are deposited.

Each week, a group of students periodically dump the containers into large outdoor bins provided by Waste Management.

As of June 4, 2019, Waste Management notified the Shenandoah Valley School District that they recycled 3.8 tons of paper, 2.4 tons of plastic, 0.6 tons of aluminum, 0.1 ton of glass and 5.1 tons of cardboard.

Tennessee Woman Indicted by Grand Jury for Murder of Patrick Murphy

$

On Thursday, New Orlean's District Attorney Leon Cannizzaro’s office on secured a murder indictment against a Tennessee woman accused in February of stabbing to death Patrick Murphy in a Treme hotel room.

Magen Hall was charged with armed robbery, obstruction of justice and with the second-degree murder of Patrick Murphy, 62, of Pottsville, in the three-count indictment handed up by an Orleans Parish grand jury. The defendant’s name also is spelled Megan Hall in some court records.

Hall, 25, faces a mandatory lifetime prison sentence if convicted of the murder charge. An armed robbery conviction carries a penalty of 10 to 99 years in state prison, while obstruction of justice in a homicide investigation is punishable by up to 40 years.

A housekeeper discovered Murphy’s body at 11:41 a.m. inside a room registered to Hall at the Empress Hotel at 1317 Ursulines Ave. New Orleans police homicide detective Patrick Guidry testified at a preliminary hearing in March that the owner of Murphy Jewelers in Pottsville, Pa., had been killed by three stab wounds, one to his neck and two to his abdomen.

Video surveillance cameras at the hotel showed Murphy and Hall arriving to the hotel together at 2:10 a.m. Hall was seen exiting the hotel room alone and briskly walking out the front door at 3:42 a.m., believed to be leaving with some of Murphy’s possessions.

No one else was seen entering or leaving the room until the housekeeper eight hours later, Guidry wrote in his arrest affidavit.

Two witnesses staying in an adjacent room reported hearing a man and woman loudly arguing inside the room that Hall rented around 3:30 a.m., followed by sounds of a struggle that lasted about two minutes.

Hall has remained jailed since her March 3 arrest, in lieu of a $750,000 bond set for the murder allegation. Criminal District Judge Camille Buras left that bond unchanged after the indictment was read. She deferred setting bond on the two additional charges brought by the grand jury for the judge to whom Hall’s case gets randomly allotted.

Hall has a history of prostitution arrests from New Orleans, Nashville and Houston.

Assistant District Attorney Inga Petrovich presented the case to the grand jury.

Joseph F. Gallagher, Jr., was called Home on June 12, 2019. In his final days, he was surrounded by the three girls in his life. He lived a fun-filled seventy-three years! He often referred to himself as a jack of all trades, master of none; however, the rest of us referred to him as Joseph, Joe, Joey, Dad, “ The General,” or the oilman, and he will be fondly remembered for his many talents. Two of his talents which his family greatly enjoyed are his storytelling and his gifted singing voice. Joe frequently embellished stories about himself and his beloved family, with his family hanging on to his every word to know how their personal story, which had already taken place and had a different outcome, had occurred during this storytelling session. He was also a talented singer, even though he never had any training. He frequently sang at church events and weddings. He may not have always known all the words, but he gave it his all by frequently practicing his vocals by singing in the shower. Joe who fondly spoke of his younger years and classmates, was a 1963 graduate of Ringtown High School and he was forever reminding us that his graduating class had only 17 students. Joe was known around town as the Gallagher Oil Man, a title which he loved. Joe followed in his father’s footsteps and joined his sister and brother-in-law in running a family home-heating and plumbing business, from which he retired in 2016. Joe was an avid fan of race cars and sponsored local drivers. He was such a fan, that he talked about them until his very last days. Joe was known for his love of Lionel trains, which was instilled in him by his father, and he was an active member of the train show circuit. He was a connoisseur of foods thanks to his mother. He became a lover of Chinese food back in the 1980s, thanks to his daughter Natalie. During his days raising a family, Sundays were spent at the Oasis restaurant in Hazleton until it closed; however, even until his last days, he was known to never turn down Chinese food. Joe greatly enjoyed his wife’s cooking but was a sharp critic and might have even thought of himself as a Michelin restaurant rater. He often provided his three-tiered rating scale, which included “not for me,” “it’s different,” and “excellent,” the latter was hard to come by. He enjoyed sitting on the porch and watching Ringtown’s residents pass by. He easily gained the affection of children because he was still a kid at heart. In his later years, Joe often tuned into the television. He loved watching General Hospital, although he would never admit to knowing the plot since it was a soap opera. He also enjoyed watching Clint Eastwood movies, the Godfather series, and reruns of the Titanic. Joe’s love of singing extends to his appreciation of ‘good music’ to include Frank Sinatra, Eric Clapton, The Beatles, Elvis, and many more – he even subscribed to Sirius radio! He enjoyed meeting his friends for a morning coffee at the local gas station and shooting the breeze.
While he was a simple and no frills-kind of man, he leaves behind a devoted and loving family who will miss him dearly. Joe was married to his loving wife of 40 years, Beverly Gallagher. Her fondest memories of Joe were when he met his two little girls for the first time, whom he cherished and who had him wrapped around their little fingers. His daughter Natalie Zuber (Ringtown), wife of Craig Zuber, will always remember his sweet tooth, his love of her baked goods, and when she had the ‘excellent’ rating bestowed upon her. His daughter Aimee Gallagher (Alexandria, Virginia) and her partner, Christopher Cheung, will always remember her dad’s gratitude of when they were able to tour the D-Day beaches and WWII historical sites, in Normandy, France. Joe was a GrandPaw to three gentle, Pit Bull rescue mixes, Eva, Ricky, and Amel.

Joe is also survived by his sister and business partner, Eileen Bergman and her husband, Bob Bergman (Zion Grove) and their two children, Katie Rentschler (Downingtown) and David Bergman (Orwigsburg). Joe also leaves behind numerous cousins, brothers- and sisters-in-law, nieces, nephews, and godchildren.
Joe will join his parents, Mary and Joseph F. Gallagher, Sr., his sister, Mary Gallagher, his niece, Bridget Bergman, and many friends in heaven. Joe is now at peace and we look forward to the day when we can meet him again.

Our family will hold a Celebration of Life Ceremony later this summer, and it will most likely include swiss chocolate almond ice cream, his favorite! In lieu of flowers, our family asks for donations to the Ringtown Area Senior Citizens or St. Paul’s United Church of Christ (Ringtown). And next time you eat Chinese food, watch the Godfather, or hear Eric Clapton, please think of him and smile.

A committal service will he held privately at a later date.

Pottsville Woman Charged for Being Part of a "Grandparents Scheme; Defrauding Victims of At Least $158,800

United States Attorney William M. McSwain announced Friday that Yahaira Diaz, 33, of Pottsville, Pennsylvania, was charged by Information with aggravated identity theft, mail fraud, and access device fraud. The charges against the defendant stem from her participation in what has been popularly dubbed the “Grandparents Scheme”, a type of elder financial abuse.

The charges come one day in advance of “World Elder Abuse Awareness Day” on June 15, 2019.

As alleged in the Information, the scheme operated as follows: an individual called an elderly victim posing as the grandchild of the victim, or posing as an attorney representing the grandchild. The caller claimed that the grandchild was in a vehicular accident and was arrested for driving under the influence (or some type of legal trouble). The caller then said that the grandchild needed money for bail or legal representation, and persuaded the victim to send thousands of dollars in cash via overnight delivery service to an address where the schemers retrieved the package. The schemers then continued to call the victim and demand more money until the victim realized that he or she had been defrauded and stopped sending money.

In those telephone calls, to further convince the grandparents to send cash, the co-schemers described the grandchild’s situation as increasingly serious: claiming that the grandchild had been arrested for driving under the influence; that a pregnant woman was involved in the accident; that the pregnant woman and her unborn child were injured or killed; that the grandchild would not be released from prison without additional funds; and that legal and other fees were mounting.

Diaz allegedly played a leadership role in this scheme, which she and her co-schemers perpetrated in Allentown and Bethlehem, Pennsylvania. For example, she identified and arranged for access to residential locations where her co-schemers instructed victims to send the fraud proceeds. Diaz recruited and controlled additional participants in the scheme who allowed her to use their residences for the receipt of proceeds, and who helped retrieve the packages and shared the proceeds with other co-schemers.

Diaz engaged in numerous incidents of the Grandparents Scheme as well as credit card fraud, which is also charged in the Information. In the Grandparents Scheme, Diaz and her co-schemers defrauded at least 10 elderly victims of at least $158,800 and attempted to defraud those victims of at least an additional $69,000. If convicted, the defendant faces a maximum possible sentence of 72 years in prison, including a mandatory minimum term of two years in prison.

“Crimes against the elderly target some of the most vulnerable people in our society, and schemes like the ‘Grandparent Scheme’ are particularly heinous because they prey on a senior’s love for their family,” said U.S. Attorney McSwain. “The Department of Justice is committed to protecting our seniors from fraud, and my Office will continue to prioritize prosecuting criminals who prey on our elderly residents.”

“Trying to scam strangers out of money is criminal,” said Michael T. Harpster, Special Agent in Charge of the FBI's Philadelphia Division. “Specifically targeting elderly victims because you figure they're easy marks is cruel. The FBI will never stop working to shut down elder fraud schemes like this to protect older folks and help them hang on to their hard-earned money.”

“Crimes like these against our elderly citizens are taken very seriously by law enforcement. The Bethlehem Police Department, working with its Federal partners, will investigate, arrest and prosecute individuals involved in criminal scams like these ‘Grandparent Scams,” said Mark DiLuzio, Chief of Police, Bethlehem Police Department. “As Chief, I would like to personally thank U.S. Attorney McSwain and his Office, the FBI, U.S. Postal inspectors, the Northampton County District Attorney’s Office and Bethlehem Police Detectives who all worked collectively and brought this person and her partners to justice. On behalf of all elderly citizens in the City of Bethlehem, thank you!”

The case was investigated by the Federal Bureau of Investigation, the United States Postal Service, the Bethlehem Police Department, and the Northampton County District Attorney’s Office, and is being prosecuted by Deputy United States Attorney Louis D. Lappen.

An indictment, information, or criminal complaint is an accusation. A defendant is presumed innocent unless and until proven guilty.

The Department of Justice is committed to combating elder fraud. The Department’s historic 2018 and 2019 Elder Fraud Sweeps collectively brought criminal and civil actions against more than 500 defendants responsible for defrauding more than $1.5 billion from at least 3 million victims.

The Department of Justice also provides a variety of resources relating to elder fraud victimization through its Office of Victims of Crime (OVC), which has announced a new competitive solicitation addressing enhanced multidisciplinary teams for older victims of abuse and financial exploitation (up to $375,000 each) and funding for a National Multidisciplinary Team Technical Assistance Center (for up to $3 million), which will help facilitate the expansion of elder abuse case review across the nation. The deadline is July 7, 2019.

Shenandoah Man Pleads Guilty to Heroin Trafficking

The United States Attorney’s Office for the Middle District of Pennsylvania announced that Anthony Navarro-Velez, age 33, of Shenandoah, Pennsylvania, pleaded guilty on June 6, 2019, before Senior U.S. District Court Judge James M. Munley, to conspiracy to distribute and possess with intent to distribute more than a kilogram of heroin.

According to United States Attorney David J. Freed, the defendant admitted to participating in the conspiracy during 2014 and 2015. Navarro-Velez admitted that he and others in the conspiracy distributed between one and three kilograms of heroin, which is approximately equivalent to between 40,000 and 120,000 retail bags of heroin.

Judge Munley ordered a pre-sentence investigation to be completed, and scheduled sentencing for September 9, 2019.

The case was investigated by the Federal Bureau of Investigation, the Pennsylvania State Police, and the Shenandoah Police. Assistant U.S. Attorney Francis P. Sempa is prosecuting the case.

This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and make our neighborhoods safer for everyone. The Department of Justice reinvigorated PSN in 2017 as part of the Department’s renewed focus on targeting violent criminals, directing all U.S. Attorney’s Offices to work in partnership with federal, state, local, and tribal law enforcement and the local community to develop effective, locally-based strategies to reduce violent crime.

This case was also brought as part of a district wide initiative to combat the nationwide epidemic regarding the use and distribution of heroin. Led by the United States Attorney’s Office, the Heroin Initiative targets heroin traffickers operating in the Middle District of Pennsylvania and is part of a coordinated effort among federal, state and local law enforcement agencies to locate, apprehend, and prosecute individuals who commit heroin related offenses.

The maximum penalty under federal law for this offenses is life imprisonment, a term of supervised release following imprisonment, and a fine. There is also a mandatory minimum sentence of 10 years’ imprisonment. Under the Federal Sentencing Guidelines, the Judge is also required to consider and weigh a number of factors, including the nature, circumstances and seriousness of the offense; the history and characteristics of the defendant; and the need to punish the defendant, protect the public and provide for the defendant's educational, vocational and medical needs. For these reasons, the statutory maximum penalty for the offense is not an accurate indicator of the potential sentence for a specific defendant.

According to Shenandoah Police Chief George Carado, in the early morning hours of Monday, June 17, 2019 around 2:00am, Officers William Moyer and Adam Sajone were dispatched to Turkey Hill to respond for a male lying on the ground.
