Two Schuylkill County Men Charged With Conspiracy To Distribute Heroin And Methamphetamine

SCRANTON- The United States Attorney’s Office for the Middle District of Pennsylvania announced that Marquese Whitted, age 30, and Derek Mountz, age 32, both of Schuylkill County, were indicted on January 17, 2017, by a federal grand jury for participating in a methamphetamine and heroin trafficking conspiracy that operated in Schuylkill and Berks Counties in April-October 2016. 


According to United States Attorney Bruce D. Brandler, the indictment alleges that Whitted and Mountz conspired with each other and others to distribute and possess with intent to distribute more than 50 grams of methamphetamine and more than 100 grams (which is equivalent to approximately 4,000 retail bags) of heroin during April through October of 2016. 

Whitted is also charged with nine counts of methamphetamine and/or heroin trafficking. Mountz is also charged with two counts of methamphetamine trafficking and possessing a firearm in connection with drug trafficking. 

The case was investigated by the Federal Bureau of Investigation, the Pennsylvania State Police, and the Shenandoah Police. Assistant U.S. Attorney Francis P. Sempa is prosecuting the case. 

This case was brought as part of a district wide initiative to combat the nationwide epidemic regarding the use and distribution of heroin. Led by the United States Attorney’s Office, the Heroin Initiativetargets heroin traffickers operating in the Middle District of Pennsylvania and is part of a coordinated effort among federal, state and local law enforcement agencies to locate, apprehend, and prosecute individuals who commit heroin related offenses.

This case was also brought as part of the Violent Crime Reduction Partnership(“VCRP”), a district wide initiative to combat the spread of violent crime in the Middle District of Pennsylvania. Led by the United States Attorney’s Office, the VCRP consists of federal, state and local law enforcement agencies whose mission is to locate, apprehend, and prosecute individuals who commit violent crimes with firearms.

Indictments and Criminal Informations are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court.

A sentence following a finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.

The maximum penalty under federal law for the gun charge is life in prison, a term of supervised release following imprisonment, and a fine. The drug conspiracy charge carries a mandatory minimum sentence of five years in prison and a potential maximum sentence of 40 years in prison. The gun charge also carries a mandatory minimum sentence of five years in prison. Under the Federal Sentencing Guidelines, the Judge is also required to consider and weigh a number of factors, including the nature, circumstances and seriousness of the offense; the history and characteristics of the defendant; and the need to punish the defendant, protect the public and provide for the defendant's educational, vocational and medical needs. For these reasons, the statutory maximum penalty for the offense is not an accurate indicator of the potential sentence for a specific defendant. Yeh 

Shenandoah Fire Ruled Accidental; One Injured

A fire on Wednesday morning is being ruled accidental.

Just after 9:00am, Wednesday morning, emergency personnel responded to a fully involved structure fire in the 200 Block of West Centre Street, Shenandoah.

When crews arrived they found flames shooting from the front of the home.  The fire was quickly upgraded to a 2nd alarm, calling in additional units from Frackville and Mahanoy City. 

The fire started at the home of Joseph Ulicny at  228 West Centre Street and spread to the adjacent homes at 226 and 230.  228 was reported to have suffered major damage while 226 and 230  minor smoke and water damage.  Crews has the fire under control in just under an hour.

Ulicny was reported to have suffered burns in the fire and was taken to a local hospital but his injuries were not life threatening.

State Police Fire Marshal Joseph Hall was at the scene to investigate a cause Wednesday afternoon and ruled the fire as accidental stating that the fire's origin was a supplemental propane heating source.

Pennsylvania Granted REAL ID Extension

Pennsylvania has been granted an extension until June 5, 2017 from the Department of Homeland Security (DHS) to fix state law to allow for federal REAL ID compliance after Governor Tom Wolf and bipartisan leaders including Senators Scarnati, Corman, and Costa, and Representatives Turzai, Reed, and Dermody, wrote to DHS Secretary Jeh Johnson earlier this month.

The extension will allow the Wolf administration, including the Pa. Department of Transportation (PennDOT), to work with the General Assembly to resolve Pennsylvania’s non-compliance during the current legislative session. DHS told state leaders that additional extensions may be granted, as necessary, once the commonwealth can commit to meeting all REAL ID requirements.

“I thank the leaders in both chambers for making this commitment to fix state law to allow for us to come into compliance so that no Pennsylvanians, from delivery drivers to air travelers, will be inconvenienced by the current provisions barring PennDOT from completing certain requirements,” Governor Wolf said. “My administration will continue to work with the General Assembly and the federal government to come into compliance and ensure we can resolve this in an efficient and timely manner before residents face any additional challenges.”

This extension means that on January 30th of this year, Pennsylvanians will no longer face immediate access issues when entering federal facilities. The letter from Pennsylvania leaders to Sec. Johnson can be downloaded here, along with the federal government’s response here.

“We are appreciative that DHS has provided an extension in order to preserve the ability of all Pennsylvania residents to have access to federal buildings,” said Senate President Pro Tempore Joe Scarnati and Majority Leader Jake Corman. “This added time allows us to work together to ensure the Commonwealth becomes compliant in a way that is easy for residents and cost-effective.”

“Pennsylvania has done much to make our licenses secure, the federal REAL ID law mandates more,” said Speaker of the House Mike Turzai and House Majority Leader Dave Reed. “While many legislators have concerns about REAL ID, we will work with the Senate, Wolf Administration and our Congressional delegation to ensure compliance in a reasonable and cost-effective manner to make sure Pennsylvanians have continued access to federal buildings and air travel.”

“Without this action the freedom and mobility of millions of Pennsylvanians would be at risk,” said House Democratic Leader Frank Dermody. “We are working to fix this through a bipartisan effort of the legislature in partnership with the governor.”

“I couldn’t be more pleased with the extension granted today by DHS,” State Senator Jay Costa said. Moving in this direction was the right thing to do, and gives us time to assure that we’re making the changes necessary to ensure the privacy of personal information is protected while allowing for compliance with current law. I look forward to a swift resolution to the REAL ID issue on behalf of all Pennsylvanians, who more than anything, deserve the right to travel and visit federal facilities freely and without complication.”

The Wolf administration and legislative leaders have been communicating about how to resolve Pennsylvania’s non-compliance due to Act 38 of 2012 and have looked at ways in which Pennsylvania can become compliant in the most cost-effective and straightforward way possible.

“We at PennDOT are grateful to Governor Wolf and the leaders of the General Assembly for their bipartisan cooperation that opened the door to this needed extension,” PennDOT Secretary Leslie Richards said. “It delivers relief to our citizens who need access to federal facilities. We also are gratified that the Department of Homeland Security continues to acknowledge the security advances PennDOT has delivered in its driver license.”

Photographer Picks Up Line To Help Fight Fire

Volunteer firefighters are ready to jump into action at a moments notice.

JC Kriesher, the administrator and photographer, for the website Fire & Film, responded to Wednesday's fire Shenandoah like he does any other.

Kriesher arrived at the scene of the blaze and began documenting and filming prior to the fire department .

The fire was rolling and spreading as the first fire department arrived with limited manpower.

Kriesher, who is also a volunteer for the Sheppton-Oneida Fire Department, then set up his Go Pro Camera on a parked vehicle, picked up a line and helped contain the spreading fire on the front of the homes.

"I saw that the fire was rapidly spreading from the original fire building and consuming the neighboring building on the West side which also led to the rest of the row. Manpower wasn't showing up as quickly as normal and the few people that were there were trying to accomplish many duties. My natural instincts picked up and I knew I had to help keep that fire from spreading any further down the block. I did what I could until I was relieved by volunteers that were ready to proceed into he buildings and completely extinguish the remaining fire." Kriesher said.

Jim Thorpe Police Looking for Man Wanted for Rape

The Jim Thorpe Police Department is asking for the public's help in finding a man that is wanted for rape.

The suspect is identified as Jared " Chubby" Weiss,  a white male, approximately 5'7" weight 170lbs.

He has felony warrants for Criminal Attempt, Rape of a Child, Rape by Force, Rape by Threat, multiple counts of Indecent Assault and others.

Police say Weiss is possibly in the Lansford area, as well as Jim Thorpe.

Police Looking for Men Involved in Theft at Liquor Store

The Orwigsburg Police Department is investigating a retail theft that occurred Thursday January 19, 2017 @ 5:00 pm hours at the Wine & Spirts Store located at 705 West Market Street Orwigsburg.


The investigation revealed that the two black male suspects were described as 5’11” to 6’ tall wearing black pants and black sweat shirts. One of the males wore a black baseball cap and the other male wore a black wool hat.

While in the store, both suspects shoved various types of liquor down their pants. During this and previously reported incidents, one suspect distracts the store employee by asking a the store's clerk many questions while the other conceals the merchandise.

Upon checking out at the register, the clerk confronted one of the suspects with what he had shoved down his pants, at which time the male pulled two bottles of liquor from his pants and both subsequently fled the store.

The two suspects left the scene in a small black SUV, possibly a Jeep Liberty, with the last four digits of the Pennsylvania Registration being 9017. The vehicle traveled east on SR-443. Suspects matching the description were later reported to have been at the Wine and Spirit store in Hamburg, PA at approximately  6:00pm

Ruth C. Gough
, 95, Ashland, passed away Wednesday, January 18, 2017 at Lehigh Valley Hospital, East Norwegian St. Pottsville, PA.

Born in Ashland, PA December 15, 1921 the daughter of the late Joseph and Minnie Ermert Yost. She was an Ashland High School graduate and worked as a reservation clerk with PA Railroad until retirement and the PA Telephone Company duting World War I I
.
She was preceded in death by her husband, Frank Gough in 2011; and four brothers and two sisters.
Surviving are a son and two daughters: Frank Gough Jr., Benton, PA; Sharron Batrud, Lovettsville, VA; and Eileen Gower, Landisville, PA. Five grandchildren, 12 great grandchildren. Nieces and nephews. A special thank you to Frankie Paul Jr. for all his help in recent months.

Cory Glen Sholly, 42 of Rock Rd., Pine Grove, passed away on Tuesday, January 17, 2017 at home surrounded by his family and friends.

Born on November 10, 1974 in Lebanon, he was a son of Glen L. Sholly of Cornwall and the late Connie Boughter Sholly.

He was a 1992 graduate of Pine Grove Area High School and was a member of St. Peter's Evangelical Lutheran Church, Pine Grove.

Cory worked as a truck body builder for Supreme Mid-Atlantic Corp in Jonestown for 24 years.

He was a member of Boy Scout Troop 111 and attained the honor of Eagle Scout in 1992. He was also a member of the H. H. & L. Fire Co. #1, Pine Grove and the Roedersville Game & Fish Protective Assoc. He was an avid hunter, fisherman and loved woodworking.

Surviving, in addition to his father, are his daughter Nakiya Constance Sholly of Pine Grove; two brothers, Rodney and wife Melissa Sholly of Virginia, Jeffrey and wife Chrissy Sholly of Delaware; a sister Diane and husband David Sattizahn of Pine Grove; his "step mother", Helen Kresge of Cornwall, his special companion, Anya Zelinsky and her daughters, Ava and Lena Voydik, of Pine Grove; nieces and nephews; great nieces and nephews, and his hunting community and close friends.

Funeral Services will be held on Monday, January 23, 2017 at 10:30 A.M. from the H. L. Snyder Funeral Home, Inc., Pine Grove, with Pastor Jason Stump officiating. There will be a viewing on Sunday, January 22, 2017 from 5:00 P.M. until 8:00 P.M. and Monday, January 23, 2017 from 9:30 A.M. until time of service at the Funeral Home. Interment will follow in St. Peter's Lutheran Cemetery, Pine Grove.

Attorney Fred J. Wiest, 101, of Minersville passed away Wednesday, January 18, 2017 at Providence Place, Pottsville. Born August 10, 1915 in Pottsville, he was the son of Frederick and Lulu Clappier Wiest.

Fred was a 1933 graduate of Minersville High School, a 1937 graduate of Swarthmore College, and a 1940 graduate of Harvard Law School, Cambridge, MA. He was a member of the United Presbyterian Church of Pottsville.

Fred was admitted to the Bar of the Supreme Court of Pennsylvania in 1941. On February 12, 1942, he was inducted into the United States Military and served mainly in the Northern Pacific Theatre of Operations. He was discharged as a Captain in the Army Air Force in 1946.

Fred was a sole practitioner of the law for 22 years until he joined the firm now known as Williamson, Friedberg & Jones, LLC in 1968. Ultimately, he practiced law for over 70 years and even though he retired in 2012 at the age of 97, he continued to grace the halls of the firm until the age of 99.

Known as a remarkable scholar and a true gentleman in every sense of the word; he was also an avid reader, an amateur dendrologist and keenly interested in astronomy and the stock market. Fred’s longevity and his dedication to the law, his community, and his family and friends have been unprecedented.

Fred was very much involved in his community. As a member of the Schuylkill Educational Foundation [SEF], he participated in raising money for college scholarships. The SEF became the Advisory Board of the Schuylkill Campus of Penn State University and his joint membership extended from 1954 to 2015. Fred was also a member and the last president of the Minersville Borough School Board, and served on the Minersville Planning Commission (forerunner to the Schuylkill Economic Development Corporation). In addition, he was the solicitor for Minersville Borough and the Tremont Municipal Authority. As a member of the Benevolent Association of Schuylkill County’s board, he helped provide funds for low-income residents of the coal-mining region.

Fred received many accolades and awards over the years but he will be remembered for his humility and grace.

He is preceded in death by his wife Elizabeth Schwenk Hay, a son Frederick J. Wiest, III, and sister Jean C. Wiest. Fred is survived by two children - Marian (wife of Glen Sommerfeldt) of Green Lake, Wisconsin; and Richard (husband of Rosalie LaPlaca) of Schuylkill Haven; as well as two grandsons – Jeffrey and Daniel Sommerfeldt.

Funeral services will be held at 11:30 on Saturday, January 21 from Dutcavich Funeral Home, 200 Sunbury Street, Minersville, with Pastor James Shields officiating. Family and friends may call at the funeral home from 8:00 A.M. to 11:30 A.M. Interment will be in the Charles Baber Cemetery, Pottsville.

In lieu of flowers, memorial contributions can be made to Hospice of Central Pennsylvania at 1320 Linglestown Road, Harrisburg, PA 17110; or to the Fred J. Wiest STEM Scholarship at Penn State Schuylkill, 200 University Drive, Schuylkill Haven, PA 17972. Donations will be accepted at the funeral home.

Rose Marie R. Golden, age 81, formerly of Mahanoy City, died Wednesday evening at Mifflin Center in Shillington. Born in Washington DC she was the daughter of the late Thomas J. & Rose (Pinelli) Maggenti. She was a 1954 graduate of the Academy of the Holy Name in Silver Spring Maryland where she resided as a youth. She traveled with her husband the late Capt. John J. Golden throughout his military career and worked as a clerk typist for the CIA in Washington DC retiring to Mahanoy City in 1973. She was a member of the Catholic Daughters of America, a former Girl Scout leader and member of the Mahanoy Area Football Boosters, the Frackville Seniors, was the librarian and the former Mahanoy City Catholic School, taught ceramics at Red Ridge Campground where she was known as the "Ceramic Lady" and was also a volunteer for BirthRite of Frackville. Preceding her in death in addition to her parents and her husband was a brother Francis. Survivors include a daughter Donna Marie Forster and her husband Daniel of Reading, a son John T. Golden of Huntingdon Valley, a brother Thomas of Laurel MD, a sister Theresa McGrail and her husband Michael of Hagerstown MD, a grandson Timothy John Forster and many nieces and nephews. Wristbands are available for one hour, and at the conclusion of that hour, a selected fan will randomly choose a wristband that will determine the line order. Once the line is in place, fans arriving after the wristbands were issued will be escorted to the end of the numbered line.

Fire Damages Home Friday Afternoon

A fire damaged a home Friday afternoon in Ringtown.


Around 3:45pm, Friday, emergency personnel were called to a working structure fire at 198 East Main Street, Ringtown.

When crews arrived, it was upgraded to 2nd alarm calling in addition units and tankers.

Crews had a majority of the fire under control within an hour of arrival.

The home was reported to have sustained major damage.

Borough Officials Face Charges After Altercation

Borough officials from Girardville face charges after an altercation Friday morning.


According to the State Police at Frackville, Robert Krick, 64, and Edward Burns, 64, both of Girardville had a disagreement over a Sewer Authority appointment Friday morning around 10:30am at borough hall and got into an altercation.

A borough secretary ended up braking up the altercation, but State Police were still called.

State Police cited both men with summary charges of Harassment.

Krick is the Girardville Council Vice President and Burns is a former mayor and currently the head of the Sewer Authority.

Clarence R. Yeager , 88, of Frackville, died Wednesday at Broad Mountain Nursing & Rehabilitation Center.

Born in Mahanoy Twp., May 17, 1928, He was a son of the late Clarence and Helen (Swinnick) Yeager.

Clarence R. Yeager served in the US Army in WWII.

He was a Roll Bench Operator at United Metal Receptacle, Pottsville and a self-employed auto body mechanic.

He was a member of St. Michael's Ukrainian Catholic Church, Frackville , Goodwill Hose Company; Frackville American Legion Post 398, and Disabled American Veterans.

He was preceded in death by his wife Ann (Pavlishin) Yeager in 2015; a sister Sally Fenstermacher.

Surviving are two daughters, Sandra A. Usalis of Autryville, NC; Kathleen A. Gwiazdowski and her husband, Thomas of Leesport; two sons, Robert R. Yeager and his wife Barbara Peel-Yeager of Pottsville, Eugene Yeager and his wife, Jeannie of Sacramento, CA; seven grandchildren, David K. Gerlott, Nicole A. Lightcap, Jessica L. Newman, Colin Gwiazdowksi, Anna Kate Gwiazdowski, Jenna M. Yeager and Madeline Yeager; seven great-grandchildren, Michael, Steven, Christopher, Kaitlyn, Christina, Noah and Haydyn; nieces and nephews.

We would like to express our gratitude for the care given by the staff at Broad Mountain Nursing Home

Joseph J. Faenza , 72, of 25 East Street, Port Carbon, died Thursday at home surrounded by his family from injuries sustained in a car accident.

Born in Summit Hill, December 29, 1944, He was a son of the late Ralph and Myrle Faenza.

He retired as a Drywall Finisher from Gary Krammes Drywall, Pine Grove.

He was a member of St. Clare of Assisi Roman Catholic Church, St. Clair.

He was preceded in death by son Kevin Faenza; step-daughter Michele Tomko; sister Sylvia Faenza and his faithful companion Sparky.

Surviving are his wife of 32 years Joann (Kovich) Faenza; sons Joseph Faenza of Coaldale; Thomas Faenza of Minersville; Robert J. Faenza of Harrisburg; Step Son Michael Tomko of Port Carbon; 3 Brothers William Faenza of Andreas; Donald Faenza of Coaldale; Theodore Faenza of Summit Hill; a sister Marilyn Markey of Summit Hill; 5 Grandchildren Joshua, Joseph, Amanda and Michael and J.R. 2 Great Grandchildren Jovie and Conner. Nieces and Nephews.

Edward C. Maffeo, 72, of Cressona, passed away Thursday, January 19th, at his residence.

Edward was born in Pottsville on December 3, 1944, a son of the late Bernice M. (Sticher) and Carl P. Maffeo.

He was the husband of Jean (Becker) Maffeo.

He was a member of St. Mark's United Church of Christ Cressona, Cressona Lodge #222 where he served as Past Master, Life Member of Cressona Legion #286 and former Scout Master Cressona Unit #630.

He served in the U.S. Navy as a RM3.

He was employed by R & J Bus Tours as a tour director.

Ed was a graduate of Blue Mountain High School, Class of 1962.

In addition to his wife, he is survived by daughters Michele M. Smith wife of Leonard, Auburn and Tara S. Parker wife of Michael, Hummelstown; a son Michael E. Maffeo, Myrtle Beach; grandchildren Cole Smith, Brennan Maffeo, Mya Smith, Autumn Parker and Stone Parker; brothers Carl and Jim Maffeo; sister Marcie Hipp; nieces and nephews.

A Celebration of Life Funeral Service will be held at Geschwindt-Stabingas Funeral Home, Inc. , Schuylkill Haven, at 10:30 am on Monday, January 23rd, with Rev. Bruce Dalious officiating and Rev. Karl Jones co-officiating.

A viewing for family and friends will be held Sunday evening from 6-8 pm and Monday morning 9:30 am until the time of the service at the funeral home.

Man Leads Police in Chase in Stolen Vehicle

On Thursday, around 10:40pm, Shenandoah Police responded to a radio dispatch to 8 East Centre St where a vehicle was stolen.

The complainant advised police that he left his vehicle running with the keys inside it.

Police searched the area and located the stolen vehicle on East Coal St. 

The complainant was contacted and arrived on scene moments later. The complainant indicated that items were missing from the vehicle.

Then around 11:40pm, Police received a radio dispatch to the 200 block of West Coal St for a disturbance in progress. The complainant indicated there was a male in a green Subaru honking his horn and revving his engine in the street blocking traffic.

Police arrived on scene and observed the described vehicle in the roadway blocking traffic, revving its engine and honking its horn.

The Subaru was blocking the roadway and traffic was backed up behind it. Police attempted to make contact with the driver of the Subaru but the vehicle accelerated to a high rate of speed and fled the scene.

Police caught up to the vehicle and located it parked off the road in a dirt lot in Mahanoy Township.The male, identified as Benito Reynoso was taken into custody and Police learned that the Subaru was stolen from the City of Hazleton.

Police located items on Reynoso from the vehicle which was stolen from East Centre St.

Reynoso was arraigned by the on call District Magistrate Judge Bayer for the following: theft by unlawful taking, receiving stolen property, careless driving, reckless driving, Fleeing and attempting to Elude police, resisting arrest, driving while suspended, driving without a license and numerous other traffic violations which occurred in the Borough. Reynoso was unable to post the $50,000 straight cash bail and was committed to the Schuylkill County Prison. 

Argall to Serve on Key Committees in Senate

Senator David G. Argall (R-Schuylkill/Berks) will serve on several key committees for the 2017-18 legislative session.

Argall, who will chair the Senate Majority Policy Committee, will also serve as a member of the Senate Finance Committee in order to pursue the elimination of the school property tax.

“There is no issue greater than school property tax elimination in Berks and Schuylkill counties,” Argall said. “We will also vote on public pension reform this session.”

Argall will serve as Vice Chairman of the Senate Urban Affairs and Housing Committee. Prior to joining Senate leadership, Argall chaired the committee and shepherded landmark anti-blight bills through the Senate during the 2013-14 session.

“I look forward to working with Chairman McGarrigle to provide more tools and resources for our communities so we can continue to combat blight.”

Argall will also remain a member of the Senate Appropriations Committee, which deals with the state budget.

He will also serve as a member of the Agriculture and Rural Affairs Committee and the Community, Economic and Recreational Development Committee for the 2017-18 legislative session.
